DN 403, Acknowledgment of Nonrepresentation form explains to TANF recipients that the attorneys who work in the Child Support program do not represent the custodian, but rather the attorneys represent the state’s interests.

It explains that the Child Support attorneys will not be able to help with matters such as child custody or visitation.

It explains that custodians have the right to their own attorney, at their own expense.

It is based on state law that says Child Support attorneys represent the state’s interests and there is no attorney-client relationship between the Child Support attorney and any parties of a court action.

It is important for custodians to understand the Child Support attorneys do not represent them.

Each custodian must sign and date this document.

A County Social Service Office staff member must fill in the custodian’s Client ID in the Agency Use Only box at the bottom of the document and send the original to the appropriate regional Child Support unit.
